PLEASE READ THESE TERMS OF USE (“TERMS”) CAREFULLY BEFORE USING THE WEBSITE [https://deepseekagi.org/] (THE “SITE”) AND ANY ASSOCIATED SERVICES, SOFTWARE, AI TOOLS, APIs, CONTENT, AND APPLICATIONS (COLLECTIVELY, THE “SERVICES”) OFFERED BY “ (“DEEPSEEK AGI,” “WE,” “US,” OR “OUR”).

BY ACCESSING OR USING THE SITE OR SERVICES IN ANY MANNER, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THE SITE OR SERVICES.

1. Acceptance of Terms These Terms constitute a legally binding agreement between you and DeepSeek AGI. By accessing or using the Services, you confirm your acceptance of these Terms and agree to be bound by them. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and you agree to be bound by these Terms on behalf of that organization.

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes.   

2. Eligibility and Age Restriction You must be at least 13 years old to use the Services. If you are under the age of 18 (or the age of legal majority in your jurisdiction), you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms. If you are a parent or guardian agreeing to these Terms for the benefit of a child between 13 and 18, you agree to be fully responsible for their use of the Services, including any financial charges and legal liability they may incur.   

By using the Services, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into this agreement. Some parts of the Services may have higher age restrictions (e.g., 18 years or older) which will be indicated where applicable. We assume no responsibility for any misrepresentation of your age.   

3. Use of Services and Acceptable Use DeepSeek AGI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes, subject to these Terms.

You agree not to use the Services:

• In any way that violates any applicable local, national, or international law or regulation (including, without limitation, laws regarding data privacy, intellectual property, and export control).   
   
• To engage in any activity that is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable.   
   
• To generate or disseminate content related to child sexual abuse, exploitation, non-consensual intimate imagery, self-harm, violent extremism, terrorism, or hate speech.   
   
• To impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.   
   
• To infringe upon the intellectual property rights or privacy rights of others.   
   
• To transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.   
   
• To interfere with or disrupt the integrity or performance of the Services or the data contained therein.   
   
• To attempt to gain unauthorized access to the Services, user accounts, or computer systems or networks connected to the Services.
• To use the Services to develop a competing product or service.
• To reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Services, except to the extent permitted by applicable law.
• To engage in scraping, data mining, or other automated data collection from the Services without our express written permission.
• To use AI-generated output to make decisions that have legal or similarly significant effects on individuals (e.g., in finance, healthcare, legal, employment) without appropriate human oversight, especially in high-risk domains.   
   
• To generate or distribute misleading information, particularly in sensitive areas like health, finance, or democratic processes, with the intent to deceive.   
   

4. Accounts and Security To access certain features of the Services, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account. We recommend using strong passwords and enabling multi-factor authentication where available.   

5. Fees and Payment (If Applicable) Certain Services or features may require payment of fees (e.g., API usage, subscriptions). You agree to pay all applicable fees as described on the Site for the Services you select. All fees are non-refundable except as explicitly stated in our Refund & Cancellation Policy or as required by law. We reserve the right to change our prices at any time. You are responsible for providing valid and current payment information. If your payment method fails, we may suspend or terminate your access to paid Services. All fees are exclusive of applicable taxes, which you are responsible for paying.   

6. Intellectual Property Rights

• Our Content: The Services and their original content (excluding User Content and AI-Generated Output, as defined below), features, and functionality are and will remain the exclusive property of DeepSeek AGI and its licensors. The Services are protected by copyright, trademark, and other laws of both the People’s Republic of China and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of DeepSeek AGI. We may make certain software or code available under open-source licenses; your use of such code is governed by the applicable open-source license terms.   
   
• User Content: You may provide input to the Services (e.g., text prompts) and receive output generated by the Services based on your input (“AI-Generated Output”). You retain any ownership rights you have in the input you provide (“User Content”). You grant DeepSeek AGI a worldwide, non-exclusive, royalty-free, sublicensable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your User Content solely to the extent necessary to provide, maintain, and improve the Services, and as permitted by our Privacy Policy. You are solely responsible for your User Content and represent that you have all necessary rights to provide it and grant us this license.   
   
• AI-Generated Output: As between you and DeepSeek AGI, and to the extent permitted by applicable law, DeepSeek AGI assigns to you all its right, title, and interest in and to the AI-Generated Output created specifically in response to your User Content through the Services. However, due to the nature of AI and machine learning, AI-Generated Output may not be unique across users, and the Services may generate the same or similar output for DeepSeek AGI or a third party. You acknowledge that AI-Generated Output is not currently eligible for copyright protection in some jurisdictions (e.g., the United States) if it lacks sufficient human authorship. DeepSeek AGI makes no representations or warranties regarding the copyrightability or uniqueness of AI-Generated Output. You use AI-Generated Output at your own risk. 
   
• Feedback: If you provide us with any feedback, suggestions, or ideas regarding the Services (“Feedback”), you grant us an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use the Feedback in any manner and for any purpose, including to improve the Services and create other products and services.

7. User-Generated Content Policies (If Applicable) If the Services allow users to post content publicly (e.g., in forums, comments), the following applies:

• You are solely responsible for the content you post or submit.
• You grant DeepSeek AGI a license to display, modify, and distribute your publicly posted content in connection with operating and promoting the Services.
• You agree not to post content that is illegal, infringing, defamatory, obscene, or otherwise violates these Terms or our acceptable use guidelines.   
   
• We reserve the right, but do not assume the obligation, to monitor, remove, or edit user-generated content that violates these Terms or is otherwise objectionable, in our sole discretion. We do not endorse and are not responsible for user-generated content.   
   

8. Copyright Policy (DMCA) DeepSeek AGI respects the intellectual property rights of others and expects users to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law, including the Digital Millennium Copyright Act (DMCA). Please see our separate DMCA/Copyright Policy for instructions on how to report infringement and how we handle such claims.   

9. Termination We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or follow any account deletion process provided.   

Provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimers of Warranties THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.  

DEEPSEEK AGI DOES NOT WARRANT THAT: (A) THE SERVICES WILL FUNCTION UNINTERRUPTED, SECURELY, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICES, INCLUDING ANY AI-GENERATED OUTPUT, WILL MEET YOUR REQUIREMENTS, BE ACCURATE, RELIABLE, COMPLETE, OR CURRENT. AI-GENERATED OUTPUT MAY CONTAIN ERRORS, INACCURACIES, OR BIASED INFORMATION. YOU RELY ON ANY INFORMATION OR OUTPUT OBTAINED THROUGH THE SERVICES AT YOUR OWN RISK.   

11. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEEPSEEK AGI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICES.   

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEEPSEEK AGI’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNTS PAID BY YOU TO DEEPSEEK AGI FOR THE SERVICES IN THE 12 MONTHS PRIOR TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification You agree to defend, indemnify, and hold harmless DeepSeek AGI, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Content, any use of AI-Generated Output, or any use of the Service’s content other than as expressly authorized in these Terms.
